An article published by Swashikshan - Indian Association of Homeschoolers refutes the statement.According to the article published by Swashikshan, as a response to a writ petition by Ms Shreya Sahay and others to amend the Right of Children to Free and Compulsory Education Act, 2009 (RTE) in the Delhi High Court, the government filed an affidavit stating that there is nothing illegal about homeschooling and that under the RTE Act, homeschooling is not illegal.

As per the Delhi High Court order dated 24 January 2013 regarding the petition filed by Ms Shreya Sahay & others, the petition was dismissed and withdrawn. It adds that it would not issue directions to the government to make any amendment to Section 2(p) of the RTE Act.
